Cohabitation

It is becoming increasingly common for couples to live together for a considerable amount of time before marriage if, indeed they choose to marry at all. In fact, over forty percent of couples who currently cohabit never marry.

It is a common misconception that if two people live together as a couple for a certain amount of time they will become 'common law' husband and wife. This is not true! Although greater recognition is being given to the fact that many couples choose not to marry, cohabiting couples DO NOT have the same rights as married couples. The rights of cohabiting couples are almost always inferior to those of married couples.

Cohabiting couples, whether hetrosexual or same sex, may need advice in respect of children, financial issues, pensions, wills, property rights and their rights if the relationship breaks down. We are able to offer advice on all of these issues.

Civil Partnerships & same sex relationships

The Civil Partnership Act, which came into force in December 2005, has made fantastic changes for same sex couples who wish to formalise their relationship. Although not identical to marriage, Civil Partnerships bring into contemplation many of the same issues and, in order for Civil Partnership to be legally formed, certain formalities must be completed.
